Introduction and Purpose

SmartRent Technologies, Inc. ("SmartRent" or "we") provides services that help users, including landlords, property owners, management companies, and tenants, control and monitor functions within properties such as single family houses, student rentals, apartments, and apartment complexes. This Privacy Policy applies to property visitors, landlords, property managers, owners, their service providers (collectively, "Landlords"), and tenants ("Tenants").

This Policy describes how SmartRent collects, uses, and discloses personally identifiable information ("PII") from:

  • Visitors to the marketing website (smartrent.com)
  • Users of the mobile application (the "App") and services offered at properties (the "Services")

Some sections of the Policy may not apply to all users, depending on which services or features are used.

1. Information We Collect

Personally Identifiable Information (PII)

Certain areas and features of our Services or Site require registration. To register, you must provide or verify your full name, email address, password, and phone number. Additional PII may be collected during registration, such as first name, last name, email address, physical address, telephone number, and information about the property and your lease. Some information may be provided by your Landlord. When making purchases through the SmartRent Marketplace, we may collect your full name, email address, billing and mailing addresses, and payment information (collected by a third-party payment processor). Support call recordings and video recordings during remote assist sessions may also be collected.

Non-PII

This includes browser type and version, operating system, referral source, length of visit, page views, demographics, interests, online habits, geographical location, analytical data, temperature settings, leak monitors, security data, motion and broken glass sensors. This information may be combined with PII.

Our Site Collects:

  • Domain name
  • Browser type, session details, telemetry data, operating system, and system details
  • Web pages viewed, links clicked, IP address
  • Length of time on the Site
  • Referring URL
  • Device location information (optional)

Our App & Services Collect:

  • Unique identifiers, session details, system details, telemetry data, device name and model, operating system type, name, and version
  • Language information
  • Information from third parties
  • Activities and information collected by or within the App and Services (e.g., turning lights on/off, temperature settings, leak monitoring, photographs, parking, movement throughout the property, access to areas, etc.)
  • Length of time logged into the App or Services
  • Location information (optional)

2. Why We Use Your PII

  • Providing and Improving Services: To provide services, communicate with users, respond to inquiries, fulfill orders, and for customer service. Calls with customer support may be monitored and recorded.
  • Tailoring Content: To personalize content, information, and experiences.
  • Protecting Rights and Interests: To protect safety, property, or security rights; detect and prevent fraud or illegal activity; use as evidence in litigation; conduct audits; and enforce policies and terms.
  • Legal Compliance: To comply with legal or regulatory obligations, respond to legal processes, or requests from authorities.
  • Marketing and Communications: To send news, newsletters, special offers, promotions, and advertising.
  • Research and Analytics: To understand and improve how users access and use the Site and Services.

3. How We Share Information

  • At Your Direction: With third parties at your consent or direction.
  • Affiliates: With affiliates or subsidiaries, subject to this Policy.
  • Business Partners: With partners to integrate and improve services.
  • Service Providers: With vendors, contractors, agents, and building maintenance staff. For self-guided tours, government-issued ID and a photo may be collected.
  • Analytics Providers: With analytics providers.
  • Advertising Providers: With advertising providers, including social media.
  • Business Transfers: In the event of acquisition, merger, asset transfer, or bankruptcy.
  • Landlord: With Landlords and third parties to monitor property condition and safety. For guests or prospective tenants, PII is shared with the Landlord.
  • Roommates: With roommates, information such as temperature control changes, lock/unlock events, and security settings may be shared.
  • In Response to Legal Process: To comply with legal requirements.
  • To Protect Us and Others: To investigate or prevent illegal activities.
  • To Protect Our Legitimate Business Interests: For legal rights and interests.
  • Aggregate and De-Identified Information: With Landlords and others for research or other purposes.

4. Our Use of Cookies and Other Tracking Mechanisms

SmartRent and third-party service providers use cookies and other tracking mechanisms to gather information about your use of the Site or Services. This information may be combined with other information collected from you.

  • Cookies: Identifiers transferred to your computer’s hard drive to facilitate navigation, log-in, and analytics.
  • Disabling Cookies: You can block cookies via browser settings, but some features may not function.
  • Clear GIFs, Pixel Tags, and Other Technologies: Used to track activities, manage content, compile statistics, and track email response rates.

5. Third-Party Links

The Site and Services may contain links to third-party websites. These are governed by their own privacy policies, not this Policy.


6. Security of Your PII

SmartRent uses reasonable physical, electronic, and administrative security measures to protect PII from unauthorized disclosure.


7. Access to Your PII

If you have an account, you may modify your PII by logging in and updating your profile. Copies of updated, modified, or deleted PII may remain in cached or archived pages. If you do not have an account, contact SmartRent for assistance.


8. Choices You Have Regarding Marketing Messages

You may opt out of promotional or informational messages by following instructions in the message. Transactional or account-related emails may still be sent.


9. Retention Period

Personal information is retained as long as needed or permitted for the purposes obtained, including ongoing relationships, business reasons, legal obligations, or legal positions.


10. Special Notice About Children

The Services and Site are not designed for children. If a child provides PII in violation of applicable law, it will be deleted.


11. Crossborder Transfer

SmartRent is based in the United States. Information may be transferred to and maintained on servers in the U.S. For EEA and UK users, see the Privacy Policy for EEA/UK.


12. Privacy Notice for California Residents

This section is provided pursuant to the California Consumer Privacy Act (CCPA) and applies only to California residents.

Our Role as a Service Provider Under the CCPA

When acting as a service provider to your Landlord, your PII is processed under their privacy policy. Privacy questions about your Landlord’s services will be redirected to the Landlord.

Categories of PII Collected

  • Identifiers (e.g., name, alias, address, email, account name, etc.)
  • Personal information categories listed in the California Customer Records statute
  • Protected classification characteristics under California or federal law
  • Commercial information
  • Biometric information
  • Internet or similar network activity
  • Geolocation data
  • Sensory data
  • Professional or employment-related information
  • Non-public education information (not processed)
  • Inferences drawn from other personal information

Sales of PII to Third Parties

SmartRent does not sell personal information collected through Services or the Site. Information may be shared with third parties through advertising cookies.

Categories Shared

Certain categories of PII may be disclosed for business purposes, but not sold.

Your Rights Under the CCPA

  • Right to Request Disclosure: Request information about collection and use of your PII over the past 12 months.
  • Right to Request Access: Request access to the PII collected about you.
  • Right to Request to Delete: Request deletion of your PII.
  • Right Against Automated Decision-Making: Opt out of automated decision-making technology in certain scenarios.
  • Right to Request Not to Sell: Opt out of the sale of your PII.
  • Right to Opt Out of Certain Processing: Use the Global Privacy Control (GPC) or contact SmartRent to opt out.
  • Data Portability: Request your PII in a readily usable format.

Submitting CCPA Requests

Requests can be submitted through the provided web forms or by contacting SmartRent. Verification of identity is required. Requests may be denied if exceptions apply (e.g., legal obligations, security, transaction completion).

Timing

SmartRent will use reasonable efforts to respond within 45 days. Extensions and reasons will be communicated if needed.

No Charge

Requests are processed free of charge unless excessive, repetitive, or unfounded.

No Discrimination

SmartRent will not discriminate against individuals for exercising their rights under the CCPA.
